Waste Removal Bermondsey Terms and Conditions

These Terms and Conditions set out the basis on which Waste Removal Bermondsey provides waste collection and related services to domestic and commercial customers. By booking a collection, requesting a quotation or otherwise using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

Customer means the person, business or organisation requesting or receiving services from Waste Removal Bermondsey.

Services means waste removal, rubbish clearance, bulky item collection, recycling collections, and any ancillary services provided by Waste Removal Bermondsey.

Waste means any rubbish, unwanted items, debris, furniture, appliances, garden waste, commercial waste or other material agreed to be collected as part of the Services, excluding any prohibited items.

Contract means the agreement between Waste Removal Bermondsey and the Customer for the provision of Services, incorporating these Terms and Conditions and any written quotation or confirmation issued by us.

2. Scope of Services

Waste Removal Bermondsey provides waste collection and removal services within Bermondsey and surrounding areas, subject to availability, vehicle access, applicable regulations, and these Terms and Conditions.

The specific type, volume and nature of Waste to be collected will be confirmed when you request a quotation or booking. Our Services may include domestic waste removal, office clearances, construction and renovation waste collections, garden waste removal and other non-hazardous waste streams, as agreed in advance.

We reserve the right to refuse to collect any items that are hazardous, prohibited by law, incorrectly described, unsafe to handle, or exceed the agreed waste type or volume.

3. Booking Process

3.1 Bookings may be made by telephone, email or through any booking system operated by us from time to time. A booking is an offer by the Customer to purchase Services in accordance with these Terms and Conditions.

3.2 We will confirm acceptance of your booking in writing or verbally, at which point a Contract will come into existence. Any quotation provided prior to booking is an invitation to treat and not an offer. We may refuse any booking at our discretion.

3.3 When making a booking, you must provide accurate information, including:

a. The full collection address and any access information.

b. A description, estimated volume or weight of the Waste.

c. The property type and any access restrictions such as height limits, stairs, parking restrictions or entry codes.

d. Your preferred collection date and time window.

3.4 Our quotation and booking confirmation will be based on the information you provide. If on arrival the Waste differs in type, volume, weight or location from that described, we may adjust the price, modify the Services, or decline to carry out the work.

3.5 All bookings are subject to vehicle access being available and lawful parking being possible. You are responsible for arranging any parking dispensations, permits or access permissions necessary at the collection site unless we specifically agree otherwise.

4. Estimates, Quotations and Pricing

4.1 Prices are usually based on the estimated volume, weight, type of Waste, labour required, and access conditions. We may provide an estimate in advance and confirm the final price upon arrival and assessment of the load.

4.2 Any quotation is valid for a limited period as stated in the quotation or, if not stated, for 14 days from issue. We reserve the right to amend quotations if there is a material change in circumstances, disposal costs, regulatory requirements or the information provided by you.

4.3 If the actual Waste is less than the amount originally stated, we may, at our discretion, adjust the price accordingly. If the actual Waste is more than originally stated or more difficult to access, additional charges may apply. We will explain any revised charges before proceeding.

5. Payments and Invoicing

5.1 Unless otherwise agreed in writing, payment is due on completion of the Services at the time of collection. We accept payment by cash, major debit and credit cards, bank transfer and other methods as notified from time to time.

5.2 For business customers with approved credit accounts, payment terms will be agreed separately and confirmed in writing. If no such terms are agreed, payment shall be due immediately on receipt of invoice.

5.3 All prices are quoted exclusive of VAT unless otherwise stated. If VAT applies, it will be added at the prevailing rate.

5.4 If you fail to make payment when due, we may charge interest on overdue sums at the statutory rate, suspend further Services, and recover from you all reasonable costs and expenses incurred in pursuing payment.

5.5 Title to any Waste transfers to us only upon loading onto our vehicle. We reserve the right to unload Waste at the collection site if payment is not received as agreed.

6. Cancellations and Amendments

6.1 You may cancel or amend your booking by giving us as much notice as possible. Any cancellation or amendment must be communicated by telephone or email.

6.2 If you cancel a booking more than 24 hours before the agreed collection time, no cancellation fee will normally be charged. If you cancel less than 24 hours before the collection time, we reserve the right to charge a cancellation fee to cover our costs, including allocated labour and vehicle scheduling.

6.3 If we attend the collection address at the agreed time and you are not present, entry is not possible, the Waste is not accessible, or the job is otherwise unable to proceed for reasons within your control, we may treat this as a late cancellation and charge a call-out or cancellation fee.

6.4 We may, on occasion, need to reschedule or cancel a booking due to vehicle breakdown, staff sickness, severe weather, traffic disruption, access issues or other circumstances beyond our reasonable control. In such cases, we will endeavour to give you as much notice as practicable and agree a revised collection time. We will not be liable for any indirect or consequential losses arising from such rescheduling or cancellation.

7. Customer Responsibilities

7.1 You must ensure that:

a. The Waste to be collected is within the scope of what has been agreed.

b. The Waste is accessible, clearly identified and not mixed with items you wish to keep.

c. There is safe and reasonable access for our staff and vehicle, including parking space where required.

d. Any necessary permissions, permits or consents for access, loading or parking have been obtained.

7.2 You are responsible for ensuring that no hazardous or prohibited materials are included in the Waste. If such materials are identified, we may refuse collection, apply additional charges for safe handling or disposal, or require you to remove such items yourself.

7.3 You warrant that you either own the Waste or are authorised by the owner to arrange for its removal and disposal. You agree to indemnify us for any claim brought by a third party asserting ownership or rights over the Waste.

8. Waste Regulations and Prohibited Items

8.1 Waste Removal Bermondsey operates in accordance with UK waste management and environmental regulations. We are committed to lawful and responsible disposal, including recycling and recovery where possible.

8.2 We will not knowingly collect or transport hazardous waste or materials prohibited under relevant legislation, including but not limited to certain chemicals, asbestos, clinical waste, pressurised containers, certain electrical items without prior agreement, flammable or explosive materials, and any waste for which we do not hold the necessary authorisations.

8.3 If you require collection of waste that may be hazardous or regulated, you must notify us in advance so that we can confirm whether we are able to handle such materials and on what terms. Additional documentation and charges may apply.

8.4 We may issue you with a waste transfer note or other documentation as required by law. You must retain any such documentation for the prescribed period.

8.5 We reserve the right to refuse, separate or return any Waste that breaches these Terms and Conditions or relevant waste regulations. Any costs incurred as a result of misdescribed or prohibited Waste may be charged to you.

9. Performance of Services and Timeframes

9.1 We will use reasonable endeavours to perform the Services on the agreed date and within any agreed time window, but any times quoted are estimates only and not guaranteed.

9.2 We shall not be liable for delays in performance caused by circumstances beyond our reasonable control, including traffic, weather, access issues, accidents, compliance checks or delays at disposal facilities.

9.3 Our staff will conduct the collection with reasonable care and skill. They may decline to carry items where, in their opinion, doing so would be unsafe, risk damage to property, or breach health and safety requirements.

10. Limitation of Liability

10.1 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter for which it would be unlawful to limit or exclude liability.

10.2 Subject to clause 10.1, we shall not be liable for any indirect, consequential or special losses, including loss of profit, loss of business, loss of opportunity, or any loss arising from delay or failure to perform due to circumstances beyond our reasonable control.

10.3 Our total liability to you in respect of all losses arising under or in connection with the Contract, whether in contract, tort including negligence, breach of statutory duty or otherwise, shall be limited to the total price paid or payable for the Services giving rise to the claim.

10.4 You must notify us in writing of any loss or damage alleged to have been caused by us as soon as reasonably practicable and, in any event, within 7 days of completion of the Services. We may inspect any alleged damage before any repair or replacement is carried out.

10.5 We shall not be responsible for pre-existing damage or wear and tear to your property, or for damage arising from your failure to comply with these Terms and Conditions, including your obligations relating to access, packing, or separation of items.

11. Insurance

11.1 We maintain appropriate public liability insurance and, where applicable, employers liability insurance in connection with the provision of our Services.

11.2 It is your responsibility to ensure that you have adequate insurance in place to cover any specific risks relating to your property, business or premises.

12. Complaints and Dispute Resolution

12.1 If you are dissatisfied with any aspect of our Services, you should contact us as soon as possible with full details of your complaint.

12.2 We will investigate the matter and aim to respond within a reasonable period. We may request additional information or evidence to assist in our investigation.

12.3 In the event of a dispute that cannot be resolved directly, either party may pursue their rights through the courts in accordance with the governing law and jurisdiction clause below.

13. Data Protection and Privacy

13.1 We collect and process personal data such as your name, contact details, address and payment information in order to manage bookings, provide Services, and comply with legal obligations.

13.2 We will handle your personal data in accordance with applicable data protection laws. Your information will not be sold to third parties and will only be shared where necessary to perform the Contract, comply with law, or with your consent.

14. Variation and Assignment

14.1 We may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to the Contract.

14.2 We may assign or subcontract our rights and obligations under the Contract, provided this does not reduce the level of service to you. You may not assign your rights under the Contract without our prior written consent.

15. Severability

15.1 If any provision or part-provision of these Terms and Conditions is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted.

15.2 Any modification or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the remainder of these Terms and Conditions.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter or formation.

By booking or using the Services of Waste Removal Bermondsey, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions.
